Worker Protection Statement
PrimeInstall LLC is committed to protecting the rights, safety, and well-being of all employees, contractors, and technicians ("Workers"). This policy establishes comprehensive protections and legal safeguards for our workforce.
1. Worker Classification and Status
All Workers performing services on behalf of PrimeInstall LLC are either:
- Employees properly classified under federal and state labor laws
- Independent contractors operating under written contractor agreements
Company maintains full compliance with worker classification requirements under the Fair Labor Standards Act (FLSA), New York Labor Law, and IRS regulations.
2. Indemnification of Workers
PRIMEINSTALL LLC AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ALL WORKERS FROM:
- Claims arising from work performed within the scope of their duties
- Client disputes, property damage claims, or service complaints related to authorized work
- Third-party litigation arising from Company-directed activities
- Personal injury claims resulting from site hazards or unsafe client conditions
- Legal fees and costs associated with defending work-related claims
This indemnification does not extend to willful misconduct, criminal activity, gross negligence, or actions outside the scope of employment or contract.
3. Insurance and Liability Coverage
Company maintains comprehensive insurance coverage including:
- General Liability Insurance covering work-related property damage and bodily injury
- Workers' Compensation Insurance as required by New York State law
- Professional Liability Insurance covering errors and omissions
- Commercial Auto Insurance for company vehicles
Workers are protected under these policies when performing authorized work activities. Company shall not require Workers to assume liability beyond the scope of legal requirements.
4. Safety Protections
Workers have the right to:
- Refuse work deemed unsafe or in violation of safety regulations
- Report safety hazards without retaliation
- Receive proper safety equipment and training
- Work in environments free from known hazards
- Receive immediate medical attention for work-related injuries
Company complies with all OSHA regulations and New York State workplace safety requirements. Workers shall not be penalized for prioritizing safety over productivity.
5. Protection from Client Misconduct
Workers are protected from:
- Harassment, discrimination, or abusive behavior from clients
- Threats, intimidation, or physical violence
- Unsafe or hazardous working conditions created by clients
- Demands to perform work outside the scope of authorization
- Requests to violate building codes, safety regulations, or Company policies
Workers are authorized to leave any site where they feel unsafe or threatened. Company will pursue all available legal remedies against clients who mistreat Workers.
6. Non-Retaliation Policy
Company strictly prohibits retaliation against Workers who report safety concerns, client misconduct, workplace violations, discrimination, harassment, or other legal or ethical issues. Workers who experience retaliation should immediately report it to management or legal counsel.
7. Legal Representation
Company will provide legal representation and bear legal costs for Workers facing litigation arising from work performed within the scope of their duties. This includes defense against client lawsuits, third-party claims, and regulatory proceedings related to authorized work.
8. Dispute Resolution
Workers have access to fair dispute resolution processes for:
- Payment disputes
- Working condition concerns
- Safety violations
- Discrimination or harassment claims
- Contract interpretation issues
Company is committed to resolving Worker concerns promptly and fairly through internal processes before escalating to formal legal proceedings.
9. Compliance with Labor Laws
Company complies with all applicable labor laws including:
- Fair Labor Standards Act (FLSA)
- New York Labor Law
- Occupational Safety and Health Act (OSHA)
- Americans with Disabilities Act (ADA)
- Equal Employment Opportunity (EEO) laws
- Workers' Compensation laws
10. Worker Support and Resources
Company provides Workers with access to support resources including safety training, equipment, insurance information, legal guidance, and conflict resolution assistance. Workers are encouraged to raise concerns through appropriate channels without fear of retaliation.
